Bankruptcy is debt relief governed by federal law. Its origin is found in Article I of the Constitution of the United States.
Chapter 7 is referred to as liquidation. It allows people who qualify to erase some or possibly all of their debts by obtaining a Discharge of Debts from a Federal Bankruptcy Court.
Chapter 13 is referred to as reorganization or rehabilitation. It allows qualified people to enter into a reorganization plan. This can provide a variety of different kinds of relief. It may allow someone to catch up on their debts when they have fallen behind, and prevent reposition of foreclosure. It may allow someone to pay some debts back over time at a reduced interest rate or without any interest. It may also provide a way to adjust the amount of debt that is paid back.
